User Terms and Conditions for waba.streakmsg.com 1. Agreement Overview By using the services provided by waba.streakmsg.com ("Service"), the user ("Customer") agrees to comply with these Terms and Conditions, along with any other agreements or policies incorporated by reference. This agreement is binding upon the user once the service is activated. 2. Service Description waba.streakmsg.com provides a platform for WhatsApp Business API integration, allowing customers to send messages, automate communication, and manage their customer interaction through WhatsApp. The Service is designed to provide a robust communication channel between businesses and their customers. 3. Account Registration & Eligibility To use the Service, the Customer must register and provide accurate information during the registration process. The Service is intended only for businesses that meet the eligibility requirements set by META for WhatsApp Business API. 4. Contract Duration & Termination The Service is provided on a subscription basis, with the specific contract duration defined during the onboarding process. The contract will automatically renew unless terminated by either party as specified under the termination clause. 5. Pricing & Payment Terms The Customer agrees to pay the subscription fee for the Service as per the plan selected during registration. Any additional charges for services outside the scope of the subscription plan will be communicated in advance. Payment must be made as per the agreed schedule, and late payments may result in service suspension. 6. No Refund Policy Except as otherwise stated, all payments made for the Service are non-refundable, even if the Service is terminated early or not fully utilized by the Customer. 7. Service Availability Zeus Technologies commits to providing continuous availability of the Service. However, the Service may be temporarily unavailable due to maintenance or technical issues. In such cases, Zeus Technologies will make reasonable efforts to restore the Service promptly. 8. Customer Responsibilities The Customer is responsible for: Ensuring that their use of the Service complies with applicable laws, including data protection and privacy regulations. Maintaining the confidentiality of their account credentials. Ensuring that the data entered into the Service is accurate, up-to-date, and legally obtained. 9. Data Privacy & Security Zeus Technologies is committed to protecting the privacy and security of Customer data. Customer data will not be shared with third parties without prior consent unless required by law. Zeus Technologies will implement appropriate technical and organizational measures to protect data from unauthorized access or breaches. 10. META Compliance The Customer agrees to comply with all relevant META guidelines and policies, including those related to WhatsApp Business API usage. Zeus Technologies is not responsible for any actions taken by META, including account suspension, termination, or restrictions due to non-compliance with META’s rules and regulations. 11. Usage Restrictions The Customer agrees not to use the Service for illegal activities, including but not limited to: Spamming or sending unsolicited messages. Sending harmful or offensive content. Violating intellectual property rights. 12. Support Services Basic support services are provided as part of the subscription. Additional technical support, consulting, or custom development services will incur extra charges at the rates specified by Zeus Technologies. 13. Termination of Service Either party may terminate the agreement by providing written notice in case of breach of the terms by the other party. Zeus Technologies reserves the right to terminate the Customer's access to the Service in the event of non-compliance with these Terms and Conditions. 14. Limitations of Liability Zeus Technologies will not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Service, including but not limited to data loss, business interruption, or personal injury. 15. Indemnification The Customer agrees to indemnify and hold harmless Zeus Technologies, its employees, contractors, and affiliates from any claims, damages, or expenses arising from the Customer’s use of the Service, including any legal costs or fees incurred. 16. Governing Law & Dispute Resolution These Terms and Conditions will be governed by the laws of the United Arab Emirates. Any disputes arising under this agreement will be resolved through arbitration or legal proceedings as deemed appropriate by the courts in Dubai. 17. Changes to Terms Zeus Technologies reserves the right to modify these Terms and Conditions at any time. The Customer will be notified of any changes, and continued use of the Service constitutes acceptance of the updated terms.
